Without sending you guys through all of the details... lets agree that our aircraft DO come under the guidelines of section 336 (they are model aircraft)... with that understood, here's an excerpt from this week's FAA ruling.....


However, the prohibition against future rulemaking is not a complete bar on rulemaking that may have an effect on model aircraft. As noted above, the rulemaking limitation applies only to rulemaking actions specifically “regarding a model aircraft or an aircraft being developed as a model aircraft.” P.L. 112-95, section 336(a). Thus, the rulemaking prohibition would not apply in the case of general rules that the FAA may issue or modify that apply to all aircraft, such as rules addressing the use of airspace (e.g., the 2008 rule governing VFR operations in the Washington, DC area) for safety or security reasons. See 73 FR 46803. The statute does not require FAA to exempt model aircraft from those rules because those rules are not specifically regarding model aircraft.


So, in their interpretation, rule 336 applies to aircraft, but FAA guidelines, not a congressional document, govern the use of airspace. As much as I believe the ruling is BS... I have to agree with them on that point.

Yes I'm registering. And I'm going to show and encourage others to show what good and responsible people AMA members are while the FAA watches.

Together we stand, divided we fall. We can buck the system and become part of the "drone war problem" or we can register and further separate ourselves from the ones that do not.

Here's the reality......it doesn't affect us. A modeling friend of mine put it this way, "we can scream civil liberties and slippery slope and all the other NRA worries, but it’s toy airplanes. Those aren’t real worries until people are actually doing damage with our toys."
This is the problem with this country right now. "Its only $5", "I love this sport so much I will just pay it". Everything freedom we have lost in the last 30 years has started this way. If everyone truly loves this sport, than stand up for it. Don't register with the faa or the ama and don't fly.

The statue 336 does apply to the pilots and the airspace, otherwise there would not be references as to it's operation in accordance to a CBO', or in regards to yielding the right of way to full scale, or contacting a flight tower if flying within 5 miles of the airport. By stating how it is to be flown is including the pilot and airspace, one can't very well use those model aircraft if one can't use those model aircraft thus making any law or ruling a mute point, so why was the law enacted ???!!!!

It seems like every hobby I have, eventually gets attacked. I used to eat sleep and breathe hunting. And then, the treehuggers decided that the wolves need to be re introduced to northern minnesota. In the last 5 years it went from seeing 3 deer a day to no deer in the woods for the last 2 years. This last hunting season, it was wolves howling every evening less that 1/4 mile away from us, running the deer.........and eating peoples dogs, killing cattle, attacking horses. We can't shoot them because they are protected. That hobby shot in the arse. I used to be into long range shooting. Guess what...once again, pending legislation and media flogging, sends ammo prices skyrocketing. Reloading supplies, ultra hard to find. So I sell off my expensive precision rifles to fund airplanes...... Now this crap starts. Are you seeing the pattern here people? Wake up!!!! Quit giving money to the people that pee your freedoms away for the sake of keeping themselves on top. I will hold off on everything until spring. If no reversal on this. It is massive sell off time. And I won't look back. As it is I get sick to my stomach when I look at my planes now.
