Except, that now if/when you register you are required to state that you will not fly over 400 ft. I will wait to register, I know that in ALL of the IMAC contests I have attended we do not follow that limit. I am hoping that the AMA will allow for use of our AMA # and by pass having to agree to this.

Not true.... you are required to "acknowledge" the "guideline" not to fly over 400 feet..... huge difference.

"I have read, understand, and intend to follow the safety guidance"

You have agree to follow the guidance not to fly over 400 feet. There really is not any wiggle room in that. It clearly says that you intend to follow the guidance.

True, BUT there is a huge difference in prosecuting something that someone says they "INTEND" to do , but don't...... than it would be to prosecute someone for a specific rule or law that was broken.
Specifically... I don't fly over 400.... but I do not persecute those that do , or want to.....
but even IF , I would go over 400 it would be marginal and would not be intentional....... but someone flying a "drone" at 2000 feet is definately doing it intentionally .

With that said........When the time comes and there is only "registration" in order to fly a toy plane then I will decide to either register or pack this hobby in for good. The choice will be mine and mine alone. Keep in touch with me! I may just have a whole lot of RC goodies for you!

A guideline is just that..... not a rule, or law that is enforceable or prosecutable.

Sort of. But in this case it backs you into a corner. You agreed to follow the guideline, which is not a rule as you correctly point out. However, in agreeing to follow it if you cause an incident above 400 feet the FAA will likely invoke Part 91.13 - Reckless or Careless operation because you violated the guideline you agreed to follow. It is a de facto rule making process that likely will end up being a loser in court and a moot point once the NPRM is finalized, but it may cost you a bunch of money to prove your innocence.

Which is why I am holding off until the last minute (2/19/16) to see what the AMA is able to accomplish (if anything).
